In accordance with the provisions of Article 10 of Law 34/2022, of July 11, on Information Society Services and Electronic Commerce (LSSI), we inform you that the "Publishing System" application is owned by EDITORIAL LUIS VIVES, hereinafter EDELVIVES, an entity belonging to the Institute of Marist Brothers of Education, registered in the Register of Religious Entities of the Ministry of Justice, under the number 1334-i/28-SE/B, with C.I.F. R-5000274-J, and address at Madrid road 315, postal code 50012-Zaragoza.
The observance and compliance with the provisions contained in this Legal Notice are enforceable with respect to any User of the application. If you do not agree with any of the terms set forth here, we recommend that you stop accessing and using the application.
General terms of use
These conditions regulate the access and use of the "Publishing System" application, without prejudice to the fact that EDELVIVES reserves the right to modify the presentation, configuration and content of the application, as well as the conditions required for its access and use. The access and use of the application after the implementation of modifications implies acceptance of them.
Access to certain services may be subject to specific conditions that will, in any case, be properly displayed. These must be expressly accepted by the User, and may replace, complete or modify these terms of use.
EDELVIVES reserves the right to modify the terms and conditions stipulated here, in whole or in part, and must publish any changes in the same way these terms of use appear or through any type of communication directed at the User.
Access and security
"Publishing System" is an internal application of EDELVIVES, so those who can register and access are those who are employees or external collaborators of EDELVIVES, with prior authorization from EDELVIVES. Generally, access to the application by the Users to whom it is directed is free of charge.
However, EDELVIVES reserves, in accordance with current legislation, the right to limit access to certain areas of the application for which the User must register by providing all the information requested.
EDELVIVES grants the User a free use license to use the application in a non-exclusive, and non-transferable manner, for the sole purpose of using the "Publishing System" for the purposes it was designed for. This will be in effect during the time the User maintains his access account to the application.
EDELVIVES will not be responsible in any case for the truthfulness of the registration data entered by the User, this being responsible for the possible consequences, errors and failures that may subsequently arise from the lack of truthfulness of the data.
Intellectual and industrial property rights
EDELVIVES is the owner or, where appropriate, has the corresponding licenses on the exploitation rights of intellectual and industrial property of the application, as well as the intellectual and industrial property rights on the information, materials and contents of it, including that which is carried out within the application itself.
The access and use of the application by the User cannot be understood in any case as a waiver, transmission, license or transfer, total or partial, of the aforementioned rights by EDELVIVES in favor of the User or third parties.
Specifically, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and in any form, all or part of the contents included in the application, for public or commercial purposes, as long as EDELVIVES, or where appropriate the legitimate owner of these rights, has not previously authorized it expressly and in writing.
The User will have access to the contents owned by EDELVIVES as long as there is a contractual relationship between both Parties.
In the event that the User sends information to EDELVIVES through the application or by any of the channels enabled for this purpose, the User declares, guarantees and accepts that he has the right to do so freely, that such information does not infringe any intellectual property, industrial, trade secret, or any other rights of third parties, and that such information is not confidential nor is it harmful to third parties.
The User assumes responsibility for any communication he supplies, personally or on his behalf. Such responsibility without any restriction includes accuracy, legality, originality and ownership of the same.
3.1 Trademarks
Unless expressly stated otherwise, access and use of the application does not confer any right on the User over the distinctive signs included in it. For the use of the registered trademarks or trade names, or other distinctive signs referenced in the application, owned by EDELVIVES or third parties, the consent of EDELVIVES or its legitimate owners will be required.
In case of non-compliance by the User with the provisions in this section, EDELVIVES will be empowered to exercise the actions recognized in the current legislation relating to these rights.

4.1 Links to other websites
In the event that links to websites are displayed in the application through different buttons, links, banners or embedded content, EDELVIVES informs that these are directly managed by third parties, EDELVIVES not having human or technical means to know in advance, control and approve all the information, content, products or services provided by other websites.
EDELVIVES will not assume any responsibility for any aspect related to the website to which a link could be established from the application.
If the User has actual knowledge that the activities carried out through any of the third-party websites with a link in the "Publishing System" application are illegal or contravene public order, he must immediately communicate it to EDELVIVES through any of the indicated communication channels, for the purpose of disabling access to these links, which will be carried out in the shortest possible time.
The establishment of links from the application to third-party websites does not imply that there is any type of relationship, collaboration or dependence between EDELVIVES and the third party responsible for the website.
4.2 Third party links
EDELVIVES may make available to the User link means that allow them to access channels and various web pages, with the aim of facilitating access to such channels on different platforms and social networks.
The establishment of these applications does not imply the existence of any relationship between EDELVIVES and the owner, manufacturer or distributor of the linked platform, nor the acceptance and approval by EDELVIVES of its contents, with its owner, manufacturer, or distributor being the sole responsible for them.
EDELVIVES does not share any private information about the User with the owners of these web pages in any case. If the User provides information to these external web pages, they do so at their own risk, with EDELVIVES not intervening in this process.
EDELVIVES will not be responsible in any case for the content hosted on external websites, since it has no control over it. The User should exercise extreme caution in the evaluation and use of the information contained on these pages, and when sharing their own or third-party information.
4.3 Links on other websites to the application
EDELVIVES does not authorize the establishment of links to the "Publishing System" application on those web pages that contain materials, information or illicit, illegal, degrading, obscene content, and in general, that contravene laws, morals or public order and good customs.
EDELVIVES does not have the power or human and technical means to know, control, or approve all the information, contents, products, or services provided by other websites that have established links to the present Website.
EDELVIVES assumes no responsibility for any aspect related to the web pages that establish this link to the current application.
Conditions of use of the application
Access or use of the application for illegal or unauthorized purposes, with or without economic aim, is not allowed. The User assumes all responsibilities that may arise from the unauthorized access and use of the "Publishing System"
Non-compliance with any of these conditions by the User may lead to the adoption by EDELVIVES of appropriate measures under the law and in exercise of its rights and obligations, potentially leading to the deletion or blocking of the offending User's account, without any possibility of compensation for any damages and losses that these measures may cause to the User.
Responsibilities and guarantees
EDELVIVES does not guarantee the reliability, usefulness, and truthfulness of all the information or contents of the application, nor of the documentation made available through the application.
Specifically, EDELVIVES does not guarantee nor is responsible for:
The continuity of the contents in the application.
The absence of errors in these contents.
The absence of viruses or other harmful components in the application or on its server.
The invulnerability of the application, as well as the impossibility of breaching the security measures that are adopted.
The lack of usefulness or performance of the contents of the application.
The damages or losses caused by the User who violates these conditions, the rules, and the instructions established by EDELVIVES, whether caused to themselves or to third parties.
However, EDELVIVES declares that it has taken the necessary measures, within its capabilities and the state of technology, to guarantee the operation of the application and minimize system errors.
If the User becomes aware of the existence of any illicit, illegal content, contrary to laws or that could constitute an infringement of intellectual or industrial property rights, of the applicable regulations regarding personal data protection or any other right, they must immediately notify EDELVIVES so that it can proceed to take appropriate measures.
EDELVIVES will not be responsible for the accuracy, completeness, or updating of the information published on the application from sources external to it, nor for the damages that could arise as a result of the use of this information.
EDELVIVES reserves the right to suspend, modify, restrict or interrupt, temporarily or permanently, the access, and use of the application, without prior notice, to Users who contravene any of the provisions detailed in these conditions of use, without the User being able to demand any compensation for this cause.
Furthermore, the User is informed that, due to maintenance and updating tasks, the application may not be available at certain times. EDELVIVES assumes no responsibility for the damages that the temporary unavailability of "Publishing System" due to this cause, could cause to the User.
Privacy Policy
In accordance with the provisions of the applicable legislation on the protection of personal data, all personal data provided during the registration and use of the application will be treated in accordance with the provisions of the Privacy Policy.
The User who accepts these conditions of use, accepts in an informed, express and unequivocal way our Privacy Policy, being able to exercise the rights that correspond to them in this matter.
Validity of the conditions
If any of the conditions herein were to become null or cease to take effect between the parties, the remaining conditions will maintain their validity and enforceability for the Parties, and that null or ineffective condition should be replaced as soon as possible.
Applicable law and competent jurisdiction
Both this Legal Notice and the Terms of Use are governed by Spanish law. The Parties expressly submit to the courts and tribunals of Madrid for the resolution of controversies, waiving any other jurisdiction that may correspond to them.
